Currently the Fort Bend County Central Appraisal District is being sued by several Richmond residents.  They accuse the appraisal district of not considering foreclosures when appraising the properties.  By not using foreclosures they are not getting a true value to tax.  Since foreclosures many times sell for less then a resale home, these foreclosure could decrease the tax value of many residents homes.    

Attorney David Showalter had this to say "FBCAD has repeatedly failed to comply with the statute which provides that the chief appraiser may not exclude from consideration the value of the other residential property in the same neighborhood as the residence homestead by being appraised and would otherwise be considered in appraising the residence homestead because the other residential property was sold at a foreclosure sale." The injunction filed in this suit, according to Showalter, "would prohibit the certification of the tax rolls which is believed to have been improperly calculated, failing to consider foreclosed properties."

The Court case will go before Judge Thomas Culver(240^thDistrict Court) July 29, 2010.  He has not ruled against the case being dismissed per the appraisal district's request.  FortBendStar.com did a fantastic article on this and you can read more at: Appraisals.  Please keep in mind that the appraisal district did not comment on this article.  www.fbcad.org is the official website of the Fort Bend County Central Appraisal District.
